Zamfirescu Racoti Vasile & Partners has provided pro bono legal assistance to 45 survivors and persons close to the victims of the Colectiv Club fire before the magistrates of the Bucharest Court of Appeal.
The lawsuit started in 2015, following the fire in the Colectiv Club in Bucharest where 64 persons lost their lives and tens of others were seriously injured.
According to the firm, the Bucharest Court of Appeal partially changed the judgment of the Bucharest Tribunal, decreasing certain punishments and deciding the acquittal of some of the indictees. However, the judgment maintained the liability of the public institutions involved in the lawsuit – ISU Dealul Spirii and Bucharest's Fourth District City Hall – for the payment of damages amounting to over EUR 40 million.
"The case file was, by the extent of the damages, the complexity of the tragedy caused, and, especially, by the sphere of the guilty persons, unprecedented in the practice of the Romanian courts," Zamfirescu Racoti Vasile & Partners informed. "From this perspective, the decision solving the appeal will represent a caselaw benchmark in the future practice of the courts of law and responsible conduct guidelines for public servants and entrepreneurs."
The Zamfirescu Racoti Vasile & Partners team was led by Senior Partner Calin-Andrei Zamfirescu and included Managing Associate Doru Cosmin Ursu and Senior Assoicates Ionut Chisar and George Avram.
