Clifford Chance Represents Abener Energia in Dispute with Elektrocieplownia Stalowa Wola

Clifford Chance has represented Abener Energia in a six-year dispute and its EUR 92.8 million settlement with Poland's Elektrocieplownia Stalowa Wola power plant.

Abener Energia operates in the renewable energy sector and is a subsidiary of Spain's Abengoa, a green infrastructure, energy, and water company. 

According to Clifford Chance, “the settlement, under which ECSW undertook to pay Abener Energia EUR 92.8 million, regulates the settlement of accounts under a contract for the construction of a combined cycle gas and steam unit.”

The dispute, which lasted more than six years, included several arbitrations, litigations, and rounds of negotiations. Under the settlement, the parties have agreed to discontinue all the court and arbitration proceedings pending between them and confirmed they have no claims arising under the contract, the firm informed.
