MPR Partners has successfully represented insolvent electricity supplier Getica 95 Com in a dispute with three Auchan Group companies – Auchan Romania S.A., Coresi Business Park S.A., and Ceetrus Romania S.R.L.
According to the firm, Getica was supplying electricity to the three companies with Getica attempting several times to renegotiate the supply contracts based on electricity pricing volatility over the last 10 years. Coresi and Ceetrus ultimately unilaterally canceled the contracts by switching providers, which, the firm informed, involved higher prices than those repeatedly offered by Getica in its attempts to renegotiate the contracts. When Getica filed for insolvency in 2021, Auchan, Coresi, and Ceetrus filed a claim to recover EUR 6 million which amounted to the difference in price between their new provider and the old contract with Getica.
The Buzau Tribunal rejected the claims with the firm informing that the decision may be appealed at the Ploiesti Court of Appeal.
