Suciu Popa has successfully represented Electroputere VFU Pascani in a public procurement dispute over a public tender cancellation.
Electroputere VFU Pascani is a Romanian producer of and maintenance and refurbishment provider for freight and passenger trains and trams.
According to Suciu Popa, “the National Council for Solving Complaints and, subsequently, the Bucharest Court of Appeal upheld the arguments brought forward by Suciu Popa and established that the cancellation of tender procedures as a result of the impossibility to conclude the public procurement agreement always implies the existence of totally objective circumstances which are independent and not imputable to the contracting authority. Otherwise, as the courts upheld in this case, the cancellation measure is not legal, and the contracting authority remains obligated to conclude the public procurement agreement.”
