LCF Law Group has successfully represented Inzhur Energy in overturning a court-imposed ban on the construction of a distributed generation power plant near Kyiv.
According to LCF Law Group, the first instance court had initially ruled in favor of the prosecutor’s arguments regarding alleged non-compliance with security zones and incorrectly classified the relevant pipeline as a trunk pipeline. Following the proceedings, the Court ruled that state construction regulations concerning special construction regime zones had not been violated and that the actual protective zone is only two meters. The ruling allows Inzhur Energy to resume construction of the power plant.
