Musat & Asociatii has successfully represented Romania's Vasile Alecsandri Cultural and Scientific Society and the Ministry of Culture and National Identity in a dispute involving the classification of the Vasile Alecsandri Memorial House in Bacau as a historical monument.
The house was built in the Iasi county of Romania 1867 by Romanian poet Vasile Alecsandri who left it to the Romanian Academy upon his death. The Academy built a mausoleum containing the poet's grave and relics of his parents and wife.
According to Musat & Asociatii, the panel of three judges of the High Court of Cassation and Justice rejected the claim filed by the current owner of the Memorial House to have classification as a historical monument annulled, thus maintaining the property under the protection established under Romania's Law no. 422/2001 on the protection of historical monuments.
The Vasile Alecsandri building was classified as a historical monument in 1991 under Order no. 2314/2004.
According to Musat & Associatii, ”for over five years, local civil society and media representatives have extensively debated the disastrous situation of this building included in the cultural patrimony list and campaigned for the continuity of its classification as a historical monument in order to protect the building and to maintain the pre-emptive right of the Romanian state.” Pursuant to the law, the county directorate for culture “initiates, when necessary, or requests the county council to expropriate for public utility purposes certain historical monuments in order to save them from destruction and degradation”.
