Suciu Popa successfully represented Monsson Trading, part of Monsson Group, an international renewable energy player, in significant enforcement proceedings and a real estate mortgage against the ING Bank. The enforcement proceedings were based on a credit facility contract for sale purchase of electricity.
Through the appeal, Monsson Trading required the cancellation of all enforcement documents, the return of the execution, and the restoration of the previous situation. Monsson's appeal was dismissed at first instance, but based on the Suciu Popa’s arguments in the appeal, the court found the non-contractual and unlawful character of the execution issued by the ING Bank. As a result, teh court accpted Monsson Trading’s appeal.
