Wiercinski Kwiecinski Baehr and Drania and Partners have successfully represented the Gdansk Airport before the Supreme Court.

According to WKB, “the Supreme Court upheld a cassation appeal brought by attorneys from WKB and Drania against the judgment of the Court of Appeal in Gdansk in the dispute between Gdansk Lech Walesa Airport and Millennium Bank [together with] the trustee of Hydrobudowa.” The value of the dispute was approximately PLN 30 million.

According to WKB, the dispute “concerned factual and legal issues related to the settlements of the investor – the ordering party [Gdansk Airport] with a consortium of contractors providing the infrastructure necessary for the proper functioning of the airport. The case concerned both problems related to agreements with the consortium and their settlement, including in particular the position of the consortium leader in relation to other members of the consortium, as well as problems related to the application of the bankruptcy law on the matter,” given that the consortium leader is currently in bankruptcy.

According to WKB, the Supreme Court overturned the unfavorable judgment of the Court of Appeal for Gdansk Airport and referred the case to the court for reconsideration.
