Studnicki, Pleszka, Cwiakalski, Gorski has successfully represented Tesco Polska in a dispute regarding the existence of a legal title to a property in a Warsaw shopping and service center.

According to SPCG, “the plaintiff was the perpetual usufructuary of the land, who questioned Tesco's legal title to the property and the validity of the company's right to use it by way of an action for the issue of real estate. The adjudicating court did not agree with the plaintiff's arguments regarding the invalidity or appearance of the usufruct contract and decided that Tesco was entitled to legal title to the disputed property.”

The Warsaw Court of Appeal later upheld the lower court's holding as well.

SPCG’s team included Partners Jakub Gorski and Pawel Wec and Associate Leszek Czop.
