New Administrative Procedure Act in Hungary

The codification of a new Hungarian Administrative Procedural Act and the Hungarian Administrative Court Procedural Act had commenced in 2014.

As a result of the preparatory works, the Hungarian Government accepted the bills on the new Administrative Procedural Act and Administrative Court Procedural Act in 2016, and following a professional debate, the Minister of Justice submitted them to the Parliament on 23 September 2016. The bills are expected to be approved by the Hungarian Parliament in December 2016 and will enter into force as of 1 January 2018.

The main objectives of the new regulations are to increase the efficiency of the effective judicial protection by ensuring the direct right of judicial supervision even for a decision of the authority of first instance, to introduce a new Administrative Court with a new appeal system, to simplify and shorten the length of the codex, to introduce the ‘expeditious’ and ‘automated’ decision procedures, and to raise the general deadline to 60 days.
